Troy the Troll - 29 Jun 2005 01:30 GMT I get back from vacation. I got 4 messages at the house from law firms, 3 at the office. Turns out the sportbike accident I witnessed up close and personal 4 years ago has reached the point where my deposition is required prior to trial.
The guy who went down and got run over is suing his insurance company. I talk to his lawyer first. He relays a story from the two who crossed center that day with a tilt towards optimism. I am scheduled for a deposition with opposing counsel in a month or so.
The president might choose to lie, get disbarred, what the hell, he's the president, he'll be surrounded by young interns to grope until he dies, he doesn't need his law degree...me? They'd throw me in jail for a while just for looking at the camera cross eyed I imagine.
I am going to be forced to tell the truth about a squidrun which went bad...I hope opposing counsel doesn't know much about sportbikes....

Telling the truth is the right thing to do. Next time the guy wants to do a silly thing on a motorcycle he may think twice about it. You have a family to take care of. You don't need to get tossed in the can for trying to help some guy that did some silly stunt on the street. Hopefully the squid or former squid will learn somthing from all this. Good can come from just about anything depending at how you look at things. Regards

Two broken legs, numerous and various surgeries to repair, a knee which still doesn't work much, and 4 years later he is just now thinking about getting back on a bike. Maybe.

Yeah, but the local squidling groups get pretty cheesed at me when I start asking hard questions about the latest crash victim and how it happened, I gots my safety to think about!

And his wifey being a staunch conservative would have an excellent chance to demonstrate how to "pull one's self up by their bootstraps" in his absence.

Nah, this was Nov 2001, the guy who fell down in our lane, slid into oncoming traffic and got run over by an SUV. It might have been when I decided I wasn't amused with the chad stunt and I may have only mentioned it later when I came back. Try googling up me from the beginning of Nov2001 through early 2002 and I should have said something about it.

I remember that poor dame who snowplowed the animal or whatever it was, and perished. What a disaster. The guy leading the ride threatened to beat you to a pulp, as I recall, when his hubris was exposed.

But after the guy who fell downs attorney called me with an "optimistic" version of events I went back and started checking out everything this guy had written me after the fact when I was trying to learn from the post morteum. Nothing wrong with reviewing everything everyone has said, posted and private messaged prior to a deposition.
When I told this guys attorney that his story from the injured party was somewhat different from the story I recall immediately after the event, he didn't appear to be as prepared for it as he ought to be.

The COURT crap is fun to watch, I haven't enjoying wrecking squidlings for a decade now...its depressing, no matter how it goes down those who don't fall down feel guilt for having led the charge, hell, I feel guilt for just participating. That particular day, the day in 2001 of the accident, was either gonna be a really, really fast ride, or someone was gonna fall down and it was gonna be a long, long day. 3/4's of the way through the ride, it became a really long, long day. Directing traffic, finding a field big enough for the med-evac chopper to land, filling out witness reports for the cops, direct more traffic at the cops request while the accident is being investigated, yada yada yada....
Nobody died. Somebody could have. The somebody who could have chose to sue. The american way. I don't even know what he's sueing FOR, just that he is. I imagine it would be like Bob trying to sue the deer he hit or the state for placing a rock wall right beside the road. I dunno. The deposition was rescheduled today for the first week of September. I hope the lawyer is funny at least.

That's an interesting situation. Wonder if I'll be in it myself, given all the wrecks I've witnessed. Same could be true for most on this folder who've ridden a few years.
More amusing might be evidence discovery: some smart lawyer plucking prejudicial statements from AMS. Hell, they'd have to start long ago and fill a book with your comments, over the years, damn near ALL of which are prejudicial in some form or another. But that's alright. And they'd likely have to prove it's YOU, writing under your nome de voige.
Good luck: one would guess smart money's to tell the whole truth and nothing but, under oath, painful though it may be in this case.
Given that it's four years ago, memory plays funny tricks. Who knows what you might or might not remember.

Who knows > what you might or might not remember. The insurance company is sending me a copy of the report I filled out with the police that particular day. It'll be interesting to go and compare that to what I've posted on the subject through time.
