It was fine last fall, it runs great, if I put it in gear it just
shuts off. I checked the kick stand switch, the previous owner had cut
off the wires so that probably not it. I pushed it up the driveway
also in first gear to see if the clutch bands may have been stuck.

kick stand switch probably IS it. that's EXACTLY how they
work.

Yamaha has a safety switch on it, so when the bike is put in gear when
the kick stand is down, it will shut off. Check and see if one of the
wires for the switch is touching the frame some where. That safety
switch is what usually makes the bike do what yours is doing.
